1. Acceptance of your order:
We must receive payment of the price of the products, and the delivery charges before we can accept your order. We reserve the right to restrict the number of products you may order and to refuse any order. If you have provided us with your email address you will receive an email from us confirming that we have received your order. This email is sent automatically and does not mean that we have accepted your order. We will notify acceptance of your order by sending an email to you stating that your order has been accepted and despatched. Otherwise, our acceptance of your order takes place upon delivery of the products. Only when we have accepted your order is a binding contract created between us.
2. Prices:
Our prices are set out on our website in Pounds Sterling and are inclusive of United Kingdom-rated VAT where applicable. You are responsible for the disclosure and payment of any import duties or other taxes which apply in the country to which the products are delivered. Prices remain in force until we publish new prices on our website. Delivery charges may apply and are displayed during the order process.
All orders will be charged in Pounds Stirling as shown on your order confirmation. We can not be held responsible for any differences to the exchange rate between the time of purchase and the time the payment is completed.
Whilst we try to ensure that all prices on our website are accurate, mistakes can sometimes occur. If we discover an error in the price of products you have ordered we will contact you as soon as possible and give you the option of either reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as being cancelled. If the order is cancelled, we will refund any monies you have paid.
We reserve the right to change our prices at any time.
3. Availability:
All orders are subject to availability of products. If products you order are not available we will notify you (where possible) and, if we have received the price and the delivery charges of the unavailable products, we will refund them to you within 30 days of your order unless you agree to a longer period.
4. Delivery:
Jonny8ball.com uses a variety of delivery methods due to the vast range of products we supply and the distinct difference in shape and size. From cue tips to full size snooker tables.
 
A signature is required at the time of delivery on almost all orders.
 
We recommend that you have your order sent to a work place or to a friend or relative that will be able to sign for your order. Please note that in some cases we can only ship to paypal verified addresses.

For items stocked by us we use a courier service or Royal Mail.
Delivery by Courier
Courier services will only deliver In England/Scotland/Wales and are NOT available Saturday, Sunday and Public Holidays. Please note that additional charges will be incurred for Scottish Highlands Channel Islands, Northern Ireland and any other location over water.

Two delivery attempts will be made, if our delivery agents are unable to complete delivery by a second attempt. The goods will be returned to us and you will be offered a refund less £4.00 plus VAT which we will be charged by our carriers. Alternatively you can make the P&P charge again plus the £4.00 plus VAT and we will despatch the goods to you again. Parcels cannot be redirected to another address, but can be signed for by a neighbour at your request.  
 
 
Royal Mail
 
Items sent by us by Royal Mail will require a signature on delivery. If there is nobody to accept delivery Royal Mail will leave a card and the goods will remain at your local post office normally for 7 days. It is your responsibility to arrange for the collection of your goods. Failure to collect will result in the parcel being returned to us. If this is the case additional P&P will be required to be paid in or that we can re-despatch your goods.
 
Larger Items – Delivered by Freight or Installed
 
Some of our larger items such as pool, snooker and air hockey tables & fitness equipment etc will be delivered either direct by manufacturer, by outside freight hauler, by distributors or by our own transport. You will be contacted to be advised on how your goods will be delivered and to arrange a convenient delivery date. It is your responsibility to ensure that you will be available to accept delivery of these items. Unless otherwise agreed in writing by Jonnyball.com the delivery of these items is a doorstep delivery only without assembly or installation. Assistance may be required to be given to the delivery driver with the unloading the goods from the vehicle.
 
Please note that these items may be delivered by heavy goods vehicle, it is your responsibility to ensure or advise if there are any problems with size restriction at the delivery location for this type of vehicle. Delivery charges for these items will be required should delivery be attempted but aborted due to:-
Unavailability of persons to accept or assist with delivery or offloading, a refusal to sign a delivery note, inability to deliver due to problems with access of either vehicle or product or for any other reason outside the control of Jonny8ball.com.
If an additional delivery is required to the same or a different address, additional delivery charges will be applied.
 
A signature will be required on the delivery note for all goods delivered. In signing this note you are agreeing that all goods have been delivered in full working order and in an acceptable condition. Please therefore inspect all goods prior to signature.
 
We will give all help we can in providing you with assistance in the assembly and servicing of your product. We will not accept liability in any form such as loss or injury as a result of you moving or assembling the product yourself.
 
Delivery Times
 
Stock items will normally be despatched within 2 working days of your completed order and payment. Larger none stock items, goods designed or manufactured to a customer specific requirement or items being assembled and installed by outside agencies can take up to six weeks.
 
We accept no liability for any form of loss resulting from delays in orders due to items outside of our control
 
Damaged in Transit
 
All goods are quality inspected prior to shipping. Occasionally items are damaged in transit. Upon receipt of your goods please check them for any signs of possible damage before signing receipt. If you are unable to inspect the goods fully prior to signature then the goods must be signed for as unchecked. If goods are not signed for in this way then it is regrettable but we will be unable to claim compensation from the carrier.
 
5. Right of Cancellation:
The United Kingdom's Distance Selling Regulations 2000 provide you with a right to cancel your order for products at any time up to the end of the seventh working day following the day after the day on which you received the products. You do not need to give us any reason for cancellation. Corporate Clients please read condition 8.
For reasons of hygiene and public health you may not cancel your order for products marked with an asterisk (*) on your order form if we have already despatched those products to you.

Or email info@jonny8ball.com with details of your cancellation. If you have already received the products you must carefully repackage and return them to us. Products returned by you within the 7 working day period referred to above will be refunded in full (including the cost of sending the Products to you). However, you will be responsible for paying the cost of returning the Product to us.
 
If you cancel this Agreement on this basis and you do not return to the Products to us, we may recover the Products and charge you for the costs we incur in doing so. Similarly, if you return the Products at our expense, we may pass that expense on to you.
 
6. Returns Policy:
In addition to the right of cancellation in condition 5 above, we operate a Returns Policy. If for any reason you are not satisfied with any products bought from this website you may return them to us within 28 days of purchase for a refund or exchange provided that the products are returned to us in their original condition and carefully packaged. Please ensure to quote your order number and email address on all correspondence.
When making a refund, we will credit our delivery charges and the price of the gift-wrapping service (if applicable) if the reason for return is because of our error or if the products are damaged, defective or of incorrect quantity.

Nothing in this Returns Policy affects any statutory rights you may have as a consumer.
7. Warranties:
All products bought from our website are guaranteed against mechanical failure / faulty workmanship for 6 months from the date of purchase. If a product proves to be faulty within that period as a result of mechanical failure / faulty workmanship you may return it to us for inspection, repair, replacement / exchange. You must contact Customer Services by emailing info@jonny8ball.com before returning any product for authorisation of the return, when an authorisation number will be issued. You must provide us with the original invoice, despatch note or other proof of purchase. This warranty however excludes cloth, batteries, bulbs, balls or any other consumables purchased or supplied with the product. This warranty does not affect your statutory rights. All warranties are “return to base”, this means that the goods are to be returned to us at your expense.
You warrant to us that: you have full authority, power and capacity to enter into this Agreement and that all necessary actions have been taken to enable you to lawfully enter into this Agreement; you are legally capable of entering into binding contracts; you are resident in the England or Wales; you are at least 18 years old; the information provided in the Order is accurate; and you will be able to accept delivery of the Products as contemplated in this Agreement.
8. Trade Customers & Samples:
Trade Customers may request samples from our product range. Samples are normally charged for, plus carriage and are Non-Returnable. Purchases made by trade customers are subject to different terms and conditions which will be supplied upon request or upon receipt and prior to acceptance of our order.
9. Product Liability:
No liability will be accepted for products where they have been engraved or specially made to your requirements by a third party.
10. Complaints and Liability:
If products we deliver to you are not as ordered or are damaged, defective or of incorrect quantity you should contact us within 7 days of delivery. We will replace the incorrect, damaged or defective products or make good the shortfall in quantity or, at our option, credit the price and delivery charges of those products to you.
If you do not receive products ordered you should notify us within 28 days of the date of your order. We will deliver the products ordered or, at our option, credit the price and delivery charges of the non-delivered products to you, or if we have not accepted your order and have been unable to contact you, we will notify you of the reason for non-acceptance.
Nothing in these Terms and Conditions shall be construed to exclude or limit any rights you may have as a consumer to the extent that such liability and rights may not be excluded or limited under applicable statute or law.
11. Validity:
If any of these Terms and Conditions are unenforceable it shall not affect the enforceability of the rest of these Terms and Conditions.
12. No Variation or Representation:
Nothing said by our sales personnel shall amount to a variation of these Terms and Conditions or a representation about the nature or quality of our products.
13. Third Party Rights:
We may transfer our rights under the contract, but otherwise nothing in these Terms and Conditions shall give any person who is not a party to the contract any benefit or any right to enforce any of the terms of the contract.
14. Governing Law and Jurisdiction:
Your order and the formation of the contract shall be governed by and interpreted in accordance with English law and the English courts shall have exclusive jurisdiction with respect to any dispute arising under this Agreement.
15. Privacy Policy:
This privacy policy sets out how “Wall Leisure T/A Jonny8ball” uses and protects any information that you give “Wall Leisure T/A Jonny8ball“ when you use this website.
“Wall Leisure T/A Jonny8ball” is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.
“Wall Leisure T/A Jonny8ball” may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. This policy is effective from 1st April 2008

Images of Products on the Site are for illustrative purposes; actual Products may differ from such images.
 
This Agreement may only be varied by an instrument in writing signed by both you and us. We may revise these terms from time-to-time, but such revisions will not affect the terms of any Agreement which we have entered into with you.
